1. Personal Information Protection Officer
In accordance with the requirements of Law 25, Apte Fitness has designated a Privacy Officer. This person ensures the application of this statement and the compliance of our practices with current legislation.
Simon Ducharme serves as the privacy officer for Apte Fitness.

2. Information collected
As part of our activities, Apte Fitness may collect the following categories of personal information:
Upon joining or purchasing a service
- Last name, first name, mailing address, email address, phone number
- Date of Birth (for age verification)
- Payment information (securely processed by our payment processor - Apte Fitness does not store full banking details)
- Emergency contact (name and phone number)
- Health information relevant to your training program, if applicable and with your consent
When using the Apte Fitness app
- Progress Data (Workouts, Statistics, Goals)
- Communicating with Your Coach
- Appointments and Reservations
- Device technical data (operating system, application version)
When browsing the website
- IP address (partially anonymized)
- Navigation data (pages visited, visit duration, traffic source) via Google Analytics
- Information submitted via forms (contact requests, information requests, newsletter sign-ups)
When you are present in our gyms
- Access data (inputs/outputs via application)
- Surveillance footage (see Section 8)
We only collect the information necessary for the purposes stated in this statement. You are never obligated to provide us with information that is not justified for a legitimate purpose.
3. Purposes of collection
The personal information we collect is used for the following purposes:
- Managing Your Subscription — creation and maintenance of your member account, billing, renewal
- Service delivery — provide gym access, prepare your training and meal plans, ensure personalized follow-up
- Communication — answer your questions, provide you with important information regarding your account
- Marketing (with consent) — send you the "Apte" newsletter, promotional offers, health tips
- Improving our services — analyze the use of our site and app to improve the user experience
- Facility Security — ensure the safety of members and staff in our gyms
- Legal compliance — comply with our legal and regulatory obligations
We never use your personal information for purposes inconsistent with those for which it was collected, unless we obtain your prior consent.
4. Data conservation and protection
Shelf life
We retain your personal information for as long as necessary to fulfill the purposes for which it was collected or to comply with our legal obligations:
- Active member data: during the term of your subscription and for up to 7 years after its termination (for tax and accounting reasons)
- Lead Data and Contact Forms Up to 2 years
- Video surveillance data 30 days, unless images are required as part of an investigation
- Navigation data (analytics): according to the parameters of third-party tools (usually 13 months)
- Newsletter data: until you withdraw your consent
Security measures
Apte Fitness implements appropriate administrative, technical, and physical security measures to protect your personal information from loss, theft, unauthorized access, disclosure, copying, use, or modification. These measures include, but are not limited to:
- Encryption of sensitive data (SSL/TLS)
- Access to data is limited to authorized personnel on a need-to-know basis
- Hosting on secure servers in Canada
- Personnel training on personal information protection
In the event of a data breach likely to cause serious harm, we will notify you and the Commission d'accès à l'information (CAI) du Québec, in accordance with the requirements of Law 25.
5. Disclosure to Third Parties
Apte Fitness does not sell, rent, or trade your personal information for commercial purposes with third parties. However, we may share it in the following situations:
Service providers
We use trusted partners for certain services (payment processing, hosting, email delivery, analytics). These partners only have access to the information necessary to perform their services and are bound by confidentiality obligations.
Legal obligations
We may disclose information when legally required, including in response to a court order, government request, or to protect a person's safety.
International transfer
Some of our service providers (such as Google or Meta) may process data outside of Canada. In such cases, we ensure that adequate protections are in place, including contractual clauses that comply with the requirements of Law 25.

In accordance with Law 25 and PIPEDA, you have the following rights regarding your personal information:
Right of access
You can request to access the personal information we hold about you.
Right to rectification
You can request the correction of inaccurate, incomplete, or ambiguous information.
Right to erasure
Under certain conditions, you can request the deletion of your personal information.
Right to data portability
You can request to receive your data in a structured and commonly used technological format.
Right to withdraw consent
You can withdraw your consent at any time for marketing communications or non-essential cookies.
Right to file a complaint
You can file a complaint with the Commission d'accès à l'information (CAI) of Quebec if you believe your rights have not been respected.

7. Cookies and online tracking technologies

8. Video surveillance
Surveillance cameras are in operation in our Terrebonne and Brossard gyms for the purpose of Security of premises and people. Visible posters will inform you at the entrance to the facilities.
The captured images are stored for a maximum of 30 days, after which they are automatically overwritten, unless they are required for an investigation or legal procedure. Access to recordings is strictly limited to authorized personnel.
9. Minors
Our website is not intended for individuals under 14 years of age. We do not knowingly collect personal information from minors under the age of 14 without the consent of their parents or legal guardians. If you are a parent or guardian and believe your child has provided us with personal information, please contact us.
10. Modifications to this Declaration
Apte Fitness reserves the right to modify this privacy statement at any time. Any changes will be posted on this page with a revised update date. If the changes are substantial, we will notify you by email or by a prominent notice on our website.
